That's the law, yes. In practice, this doesn't happen. Servers are paid less than minimum all the time.

So we should fix that. Because tipping doesn’t stop an employer from taking the tips which happens as well. Many illegal things happen in practice

Of course we should fix that, but you should know, if someone doesn't tip a server, it's very unlikely that the restaurant is going to clock that and make up the difference.
