True story - I skipped school the day they did Hands Across America. I drive down to NYC with my friends and we hung out in the city. We were in front of St Patrick’s Cathedral where they were doing the holding hands thing and we wound up on the freaking news! My parents didn’t see it, but my friend’s parents did. They were more cool about it than mine would have been. Mom died two years ago. I don’t think I ever told her. I’ll tell my stepdad tomorrow. He’ll get a kick out of it.

Whew boy...well...firstly, we need to know a few things.
Average height from the waist to face of the average American male.
Let's round up to 36 inches.
The shortest distance across the contingent United States.
Call it 2,100 miles.
The quantity of American men by last year's census.
Call it 162 million.
Let's run the numbers.
162,000,000 x 36 = 5,832,000,000 inches
Converted to feet (/12) = 486,000,000
Converted to miles (/5,280) = 92,045
In fact, you'd only need 3.7 million men to run a dick suckin human centipede train from one end of the U.S. to the other and I'm starting a kickstarter campaign!

A right to privacy and right to bodily autonomy would seem to be to any reasonable person two of the several unenumerated rights.
But, as you say, since they aren't explicitly mentioned it gives unreasonable SCOTUS justices greater scope to pretend such things don't exist.
The practical problem now is that the constitution cannot be amended without a supermajority of senate (2/3 to propose) and states (3/4 to ratify). GOP controls and, due to the nature of the electoral system, will continue to control, enough of these to make a supermajority an impossibility.
No amendment will passed without the consent of the GOP. And on these two particular issues, which they have chosen as wedge issues, there will be no support.
The only way to fix this state of affairs, is through broad and deep changes to the electoral process, which will require constitutional reform.
There is no path out of this mess within the confines of the existing system. The US is a failed state. There are those preparing for violent conflict, for a coup, for secession.
The best hope is a third party lead by a charismatic leader that could split enough of the GOP vote that it would keep them out of office in 3/4 states and 2/3 of the senate. This is a fantasy, though.

Democrats just need to get serious about doing what they believe is the moral and correct thing to do by stretching the system as far as they can. This is what the Republicans do very well, except its just for their own benefit not everyones. Increase the legislature size to dilute Republicans. Gerrymander and pork barrel. Stack the supreme court and force through favourable decisions. Make police and education funding contingent on certain standards and accreditation. Apply a massive tax to ammunition and gun sales that prices in the damage such prolific ownership does. Ram through universal healthcare, with a parallel and integrated private system. Yada yada. First and foremost they needs to wash poor areas with excellent child services, education and healthcare. Lack of education = support for corrupt Republican politicians - as the Republicans fully understand.

u/azorthefirst Georgia 4d ago
The Democrats are never going to get their shit together enough to get any of that done. They are less of an actual political party at this point and more a massive coalition bringing together everyone not far right, from center right moderate conservatives to socialists. This means they cant properly maintain a coherent message or plan of action on anything that really matters. Because if they do try to do something big they risk alienating one of the internal factions and sinking the whole think. See: Build Back Better and the Infrastructure bill.

What we need is a SCOTUS that isn't a hyper-partisan shithole. And a democratic party that actually enacts progressive policies and fights back against fascism. That would be nice.
Instead, we get the "we take the high ground" fuckwads that feel all smug about doing the "proper" thing while people's rights are stripped away. Not theirs, of course, they're too rich and powerful to suffer the consequences, which is why they can be so smug.

29
u/Fynn_the_Finger 4d ago
Conservatives will absolutely do this if they ever lost their majority. But they're in no danger of losing that majority for at least a couple of decades. We need two of the six conservatives to die while a Democrats control both the WH and Senate. I can't even tell you when the last time a conservative judge died when the Democrats could name a successor it happened so long ago. We're talking FDR era.
So we don't have to worry about the Republicans expanding the SCOTUS, they don't need to.

I’m afraid it’s worse than that. We have a majority of SCJ that are ORIGINALISTS. Their decisions are based on what they think the founding fathers intended when the constitution was written… back in 1787. I don’t need to point out the obvious that our 2022 world is so vastly different from their 1787 world that there is no way they could imagine, or consider, the future implications of the Constitution.
I think Originalist mentality is asinine to begin with, and it lives in such a world of grey ambiguity that an individual can steer their decision based on any number of other world views and factors…. That’s where personal ideology comes into play. Fact is, no SCJ has made a ruling that is 100% in opposition to their personal morals and beliefs.

u/comtedeRochambeau 4d ago
I’m afraid it’s worse than that. We have a majority of SCJ that are ORIGINALISTS. Their decisions are based on what they think the founding fathers intended when the constitution was written… back in 1787.
I'm afraid that it's really what they want instead. I don't expect consistency from the religious reactionaries in the majority of the SCOTUS.
And why are the early leaders of the US prophets instead of politicians? IIRC, this cult of the "Founding Fathers" didn't begin until after the Civil War when the nation needed some common ideological ground.

And Mormons for that matter. The Christian Right is an alliance of convenience. The evangellicals have every intention of turning on their apostate allies at the earliest opportunity. This is another reason why the founders wanted no part of state organized religion--it always becomes a matter of *which* religion. They had seen the results of over two hundred years of incessant religious warfare in Europe, resulting in the annihilation of entire regions and a proportional death rate far greater than even WW2. This current Court, for all its fawning over original intent, is trying to dismantle the most important contributions of the founders.

109
u/Shawmattack01 5d ago
It's fine, but they haven't shown the true scope. In fact, this documentary reminds me of what we first started seeing back in the 90's. What's happening now goes way beyond little militias of old men who can't hit flip targets at five yards. The movement has become fully integrated into the GOP under Trump, and has actually attempted a coup right in front of the world's eyes. The revival of abortion bans will be the basis for attacking other states through overreaching prosecutions and extradition demands. Just like the fugitive slave conflicts. And this Court is not likely to stop it. That leads not simply to some yehaw hick waving his gun, but to armed state agents facing off over whether some California doctor is going to get hauled off to Texas for fifty years behind bars or maybe execution. With a breakdown of interstate relationships and no federal authority able or willing to stop the horror show, the institutions become way more vulnerable to what was attempted last year. We're only a few steps away now.

Exactly, the radical traditionalists among us Catholics are simply a means to an end. Once those ends are met, we'll be right there facing the firing sqauds, standing next to the LGBT folks, pro choice folks and other "undesirables". Its fucking sad.
58
u/SludgeSmudger 5d ago
You read that wrong.
Yes there are very hardcore, whacked out Catholics, but Catholics are not even safe from the Christian Fascists, which are more comprised of Protestant denominations like Southern Baptists and Revivalists.
Catholics have been persecuted in this country for a long time. My grandfather’s Baptist (not southern Baptist) family had strong hesitations to welcome my Catholic grandmother because they thought she worshiped Satan and had guns in their basement to take over the country.
Catholics are rather diverse and more likely to be moderate/democratic leaning in politics than most evangelist believers. Catholicism is not a strictly evangelical religion.
Catholics are often joked about by NOT being traditionalist, even though their mass and rites are extremely old and “weird” - like believing in transubstantiation, which is specifically something that the “traditionalist” faiths ridicule Catholics for because it is akin to witchcraft in their minds.
33
u/redbadger1848 5d ago
That's why I singled out the "rad-trads". They dont care what the cost is, so long as things like abortion, and LGBT rights are snuffed out. They will happily sell the rest of us out in order to achieve those ends.
12
u/SludgeSmudger 5d ago edited 5d ago
Sorry, I read that as “the radical traditionalists” being the Catholics, and not the part of the Catholic community that are the radicals. My bad.
I definitely share your feelings, although I am more of a Satanic/atheist than a Catholic anymore. Most of my Catholic family are super progressive, prochoice types and I have one family in my family that are anti-choice, anti-gay and it is really sad to see what their kids have gone through because of their indoctrination to the more extreme side of things - concerning LGBT and abortion/contraception. The mother (my aunt) was adamant that her kids would never need education on either of those things. Lo and behold, her first daughter had a teen pregnancy and had to give the child up for adoption, one of her sons went to seminary school (lots of us suspect he might be gay, but obviously it isn’t our place), and another son doesn’t speak to them anymore because of the hardcore shit they put them all through.
Everyone else in my family are pretty open minded and accepting.

Catholics also tend to joke about feeling guilty about not being catholic enough. Most of the people I hung out with who were catholic would give one hail Mary, apologize to Jesus, then do the sin we were going to do anyway. They tended to be way more laid back to life and a lot more forgiving to anyone. Some of my evangelical peers though would cringe and even condem anything fun we were doing. I've lost some friends over Pokémon.
The Catholic church might be an evil organization but at least many of the people in it were very laid back. A lot of my Pm peers didn't havethe holier than thou attitude. My wife grew up evangelical and I would go to their church every once in a while. Each time I went it got emptier and emptier. They are chasing young people away. My nephews hate going because they thinks the pastor is so angry. The message they preach is you should love God with all your might and he will love you back. But their actions say that you will never be good enough for him

If you look at what they're doing objectively, you can see this has little to do with religion. They aren't banning abortion because God says so, that's just the excuse and cover. If they were genuinely pro-life and wanting to support more children they wouldn't keep trying to defund public schools, public school lunches, SNAP, and WIC. Banning abortion and tearing down the social safety net can only be about one thing: using pregnancy and children to drive people into crushing poverty so they will have to accept shit wages and shit working conditions out of desperation. You Christians are being taken advantage of by the semi-secret pro-corporate aims of the Republican leadership. This isn't a matter of faith, it's about the money.

My own grandmother told me I was going to hell when I was 7, and then every year till she died. I was raised Catholic and am non practicing now, she was Southern Baptist.
When I was younger she would cry and wail, and one memorable instance of her trying to secretly get me “saved”, or dunked in a pool of water by some random old man and then told to rejoice. My aunt had to pull me from the baptism procession once my grandmother admitted that my mom and dad were not aware that she was having me initiated into her church.
By the time I was 14 she just told me that I deserved whatever torment was coming to me for my “malicious and sinful” ways.
Yeah, I don’t miss her.

Yes, it's pretty coo-coo for any Catholic to join into an alliance giving evangelicals power but their loyalty is to politics above their Catholicism.
They think they are one and the same but of course this is idolatry of a kind.
It just handily helped them get appointed because Federalist Society likes the Catholics the best.

It wasn’t that long ago that Irish, Italian, Spanish and Mexican immigrants were considered to be a sub class in America. Some of my older living relatives remember being discriminated against in their childhood and adolescence.
There were even immigration bans from some of those countries. And as I said, racism against them was prevalent. A big part of that hate was that they were thought to be Catholics, because Catholicism was very popular in those nations.
So it wouldn’t be surprising at all if people with those ancestries were suddenly considered subhuman again by a Christofascist regime.

Don't forget that states can ban books and words, too.
Children have prepare for the day they get murdered in their classroom, but we can't possibly let Little Timmy mention their two dads. That's going too far.

Can a State really ban the sale of a book in the USA?
→ More replies119
u/paper_tastes_good 5d ago
Basically no. When you hear about "book bans", it's usually a government funded school district choosing to remove, or just not stock, certain books in their libraries. The only thing that I know of that is actually banned is child sex abuse material. Just about everything else would be protected by the first amendment (of the US constitution/bill of rights.)

Look up all the Bernie Madoff stuff too.

That's not what they were trying to do, they were trying to derail the normal process in order to try to trigger a contingent election in congress. Idea being of course this court will sign off on it.

It's going to go like this, "Of course states have the right to disregard the will of their voters, throw out the slate of electors determined by a free and fair election, and submit a totally valid ballot of hand-picked political hacks who will gladly vote to preserve minority rule."
→ More replies27
u/lukin187250 5d ago
It's exactly the plan, in 24 Republican held state legislatures will just withhold their electors, intentionally. The goal is simple, trigger a contingent election in congress because they control 26 states. You bet your ass this court will put a nice bow of legitimacy on that and that's it folks, coup is already done and over. There will never be another legitimate election for President ever again in the United States.

u/Hippey31 5d ago

u/digiorno 5d ago
If they have both houses of congress then nothing is stopping them. They’d have to be confident the military and police would comply but other than that there is no real barrier.
Hell they could just keep impeaching people from the executive branch until the line of succession gets down to the speaker of the house. And basically any citizen is allowed to be named speaker, they don’t even have to be an incumbent representative of a state.
Theoretically all they have to do is impeach the president, Vice President and name whomever they want…

This title just seems false. From what I understand, SCOTUS made all states "shall issue", which doesnt take away regulatory process of getting a permit. It just guarantees that, if one does go through the process and passes, they are issued a permit without being denied for arbitrary reasons.
→ More replies196
u/Saxit Europe 5d ago
Correct.
Shall issue = there is a list of requirements (it can be short, it can be long, that's irrelevant for the case), if you fulfill the requirement you get the permit.
May issue = there is a list of requirements (it can be short, it can be long, that's irrelevant for the case), if you fullfil the requirement AND your local LEO likes you, you get the permit.
The case has nothing to do with how you buy guns.
→ More replies38
u/5-0prolene 5d ago
Exactly. In US law ‘shall’ equals ‘must’, ‘may’ equals ‘may or may not’. Shall = required to, may = discretion to.

u/SignorJC 5d ago
the current laws in NY and NJ essentially make it impossible. It's not based on any objective standard. In this case "may" means "will not." "Shall" means you can still create criteria that will exclude people.

The plain answer- Guns are specifically protected by the constitution and Abortion is not.
Though, I disagree with that answer bc the 9th Amendment provides protection for rights that may not be enumerated in the constitution. Abortion should be protected as a right to privacy and it does not have to be specifically mentioned in the constitution to be protected.
That being said, I agree with the ruling on CCW permits. I do not think you should be forced to provide a reason to obtain a CCW. If you are eligble for it (Pass a background check, take a class and pass it, obtain licensure) you should be able to obtain the license. I know this is reddit, and this take won't be generally liked here, it doesn't change the fact that this was the right ruling here. However they are extremely wrong on abortion.
Edit: the support here was unexpected, lol

Mainly for the following reasons 1. It’s hard to find pro-gun and pro-abortion people nowadays, though we aren’t that uncommon. 2. This sub tends to not like guns a lot, and it was my understanding that they did not agree with this ruling here, to which I apparently overestimated.
My guess is that, while my karma is in the positive here, there are still people who don’t agre

I actually strongly disagree with the “guns are specifically protected” in the context of concealed carry. If you look at the text of the 2nd amendment: “a well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
Perhaps it’s your opinion that that includes conceal carry permits, but I see nothing there that makes it unambiguously so. There’s interpretation room there - that has historically been kicked to the states to some degree.

States can regulate firearms. Once you fulfill the requirements, the permit is shall issue. No laws were abrogated except one originally put in place , back 1911, to deny .. take a guess who ?

u/AtheistBibleScholar 5d ago
The response is generally something like "Well they wouldn't have let it be something like that!" which is BS because they left the Constitution open for us to amend however we want. They wouldn't have liked women voting, Black people being citizens, or senators elected by popular vote.
I'm right with you though. Every time I hear "Where's the right to an abortion/healthcare/a living wage/to vote/etc" my answer is the 9th amendment.

Remember all those years when Republican Presidents appointed SCOTUS justices without a litmus test on abortion. Remember how they all said things like RvW was settled law or that they couldn't comment on hypothetical cases? They were "strict constructionists", which means they take a strict literal only definition of the Constitution. There's nothing in it that specifically says the words, "the government can't ban abortion". Likewise it doesn't say anything about prohibiting gay marriage, sodomy (even straight BJs), interracial marriage, etc...
Those Republican Presidents, and the Senators who approved the nominations... they were voted into office during elections where much of the country didn't even participate.
If you like freedom and having the government out of your personal life...
